Appointing a Lasting Power of Attorney

The foundation of a good Lasting Power of Attorney (LPA) is choosing the right people. For many, this means appointing family members or trusted friends. What matters most is peace of mind – knowing that the people you choose understand you, respect your wishes, and would act with care, compassion and integrity if you were unable to make decisions for yourself.

There are two types of LPA, and you can appoint attorneys for one or both:

  • Property and Financial Affairs LPA – covers decisions about money, property and finances, including paying bills, managing bank accounts and selling your home. This type can be used at your direction whilst you have capacity, as well as if you lose capacity.
  • Health and Welfare LPA – covers decisions about your care, medical treatment and living arrangements. This type can only be used once you have lost mental capacity.

Once you have decided who to appoint, we suggest you discuss the role with your proposed attorney to ensure they understand the role and the responsibility involved.

No. Appointing a Lasting Power of Attorney does not diminish your autonomy in any way. You remain entirely responsible for your own decisions for as long as you have capacity. Most people register their LPA documents with the Office of the Public Guardian and keep them safely on file, ready to be used only if and when the need arises.
