In England and Wales, the divorce process takes a minimum of around six months from divorce application to final order, assuming everything runs smoothly and neither party delays.
In practice, a divorce takes around six months at its shortest to resolve; however, the need to negotiate a financial settlement often causes the divorce to take longer to finalise. The usual approach is to progress the divorce to Conditional Order stage, then pause the process until finances are settled.
The cost of divorce has two main parts – 1: the court fee and 2: your solicitor fees.
Divorce solicitor fees vary depending on how complex things are and whether matters are contested. When the divorce itself is straightforward, solicitors fees are usually minimal, however, the costs of instructing solicitors to deal with finances can be significant.
A 50/50 split is often the starting point for negotiation in medium to long term marriages, but there is no rule to say that a spouse must receive a 50 percent split of the marital estate – savings, property and other assets.
