PFI and PPP handback planning should begin well before the final contract years, ideally seven years prior to expiry. We recommend early contract review, internal governance planning, asset condition monitoring, service transition planning and legal readiness, with structured preparation beginning years before expiry rather than months before handback. We stay closely aligned with current guidance and policy developments affecting infrastructure partnerships and contract handback, helping clients approach expiry with greater clarity and a clear understanding of risk and the options available.
Incomplete records are a common risk in long-term PFI and PPP arrangements, especially where teams or systems have changed over time. Early legal and operational review can help identify gaps and manage the risk of disputes escalating at expiry or handback.
Yes. Many PFI disputes can be resolved through negotiation, mediation or other forms of alternative dispute resolution. Early legal input is often key to narrowing issues and avoiding escalation, although we are fully prepared to act in adjudication or litigation where required in accordance with the Dispute Resolution Procedure (DRP) in the contracts.
