If you have concerns about a decision being made by a co-attorney, for example, a sibling proposing to sell a parent’s home in circumstances you do not believe are in their best interests, you are entitled to ask for evidence and a clear explanation of why the decision is considered appropriate.
If you remain unsatisfied, your first step is to report the matter to the Office of the Public Guardian. Legal advice should be sought promptly. Where necessary, decisions made by attorneys or deputies can be challenged through the Court of Protection, and our team can advise you on the strength of any such challenge and how to proceed.
It entirely depends on the individual’s circumstances, the size and shape of their estate, and the extent to which intestacy rules would produce an outcome that feels unfair or contrary to their known wishes.
