Last day to issue an ASBI

From Monday 26th October 2026 there will be no more Antisocial Behaviour Injunctions (ASBIs) granted as changes to the 2014 Act* come into force. 

Instead of an ASBI, social and local authority landlords will be able to apply for either a Respect Order (where there is harassment alarm and distress) or a Housing Injunction (otherwise very similar to the old ASBI). The main difference between the two is that breach of a Respect Order will be a criminal offence and so dealt with by the police, not a contempt application. So good relationships with your local police force will no doubt help greatly in terms of the effectiveness and enforceability of Respect Orders!

Either option will require the applicant to complete a risk assessment before going to court - no mandatory form of the assessment, but the content that must be considered is:

• risk of any person being caused nuisance or annoyance in relation to their occupation of residential premises by the respondent’s conduct
• any vulnerabilities of the respondent
• any alternative means of preventing the respondent from engaging in relevant conduct
• such other relevant matters  

The other major change to the 2014 Act* is that registered providers of social housing will also be able to apply for closure orders, not just the police and local authority.
