Senior Associate in the personal planning team.
I am a senior associate in the personal planning and management department with a particular focus on estate planning and administration of estates. I am member of the Society of Trust and Estate Practitioners and a registered trust and estate Practitioner.
I particularly enjoy advising families on planning their affairs with a view to mitigating inheritance and capital gains tax but also with the aim of achieving fairness where possible in situations where the main asset may be a family business or farm.
In relation to estate administration, I have assisted in the administration of complex trusts and estates involving overseas assets, missing beneficiaries, insolvent estates, intestacies and dealing with the deceased’s business interests to include claims for business and agricultural relief.
This case is salutary to lawyers to make sure that they get full information from the client about all of their assets, income and liabilities and family members and dynamics.
The Mental Capacity Act (“MCA”) came into force on 1st October 2007. The Act sets out important principles affecting how we should approach decision making with a person with impaired capacity.
Current Test In order for a Will to be valid the testator must have the necessary mental capacity to make the will.
