What is financial remedy arbitration?
Arbitration allows parties to choose an alternative to the court process, by appointing an independent arbitrator to deliver a legally binding resolution. Should couples fail to negotiate an outcome via mediation, arbitration ensures a final decision is made, providing certainty and closure without resorting to court proceedings.

How does arbitration work?
Arbitration starts when both parties sign an ARB1FS form, agreeing to resolve their dispute through arbitration. They can choose an arbitrator or ask the Chartered Institute of Arbitrators to appoint one. Together, they define the issues to be resolved and agree on how the process will run, including the level of disclosure and the timetable. Arbitration can be done on paper, with the arbitrator reviewing written submissions, or through in-person hearings where both sides present their cases. The arbitrator then provides a legally binding decision, which can be turned into a court order if needed.
