Course outline – TUPE masterclass

The course will be based on a sector-relevant case study to help with understanding and applying the training.

Section 1: The legalities and technicalities of TUPE

An overview of the TUPE Regulations – this is not an overly technical section but gives sufficient background and information to understand the practical implications for merging workforces.

  • What is the purpose of TUPE?
  • When does it apply?
  • What are the implications when it does apply?

Section 2: Preparing for the transfer

Delegates will understand what pre-transfer actions TUPE requires and the obligations of the transferor and transferee.

  • Employee liability information
    • What information is needed?
    • What are the time frames?
    • How best to compile the information when transferring and how best to receive and assess the information when receiving
  • Information and consultation
    • When do these obligations arise and with whom?
    • What are “measures” for the purposes of TUPE and what does consultation look like?
  • Dismissals and transfers
    • When is it lawful to dismiss prior to a transfer and what are the ramifications of other dismissals?

Section 3: Post transfer

This covers managing post-transfer issues such as aligning cultures, embedding new joint values, and changing teams without breaching TUPE.

  • Aligning cultures of merging workforces
    • When can transferring contracts be changed?
    • What’s an economic and technical reason?
    • What are some practical solutions?

Section 4: Tricky issues

Learn about difficult issues our team has encountered and advice on how to proceed, including:

  • Sponsorship licences and overseas workers
