Mental Capacity Cases – how we can help
Roger, a self-employed kitchen fitter, suffered at stroke whilst at work, and was left unable to read or write. Urgent action was required as a tax bill and other debts and contracts were outstanding, so his daughter Paula approached Anthony Collins Solicitors for assistance.
We made an application on Paula’s behalf to the Court of Protection, and obtained for an order appointing her as Deputy for Roger, with specific authority to deal with the business on his behalf.
Paula was then able to liaise with the creditors and debtors of the business, to gather in all outstanding payments due to Roger, and to settle his debts.
Paula has also negotiated a sale of the goodwill of the business to Doug, Roger’s only employee, so that Doug can continue with the business.
Roger, sadly, is unable to return to work. However, his own financial future is now secure, and with the knowledge that his business affairs are being managed well by Paula, with the support of Anthony Collins Solicitors, Roger has been able to concentrate on his recovery and has now returned home following rehabilitation.
