Divorce settlements see the Child paid for until the age of 18

We acted for wife, who had been married to her husband for 9 years by the time they separated and they had two young children who remained living with wife. The parties separated when the husband went to live with his new partner in Devon, leaving wife with the children in their jointly owned home.

Despite our efforts to try to settle matters out of court, the husband did not respond to early offers. We therefore issued court proceedings, which we were able to settle amicably and without the need for a contested final hearing, which saved our client a lot of money.

We were able to secure the house for the wife until the youngest child reached 18 or finished full time education, whichever happened last. The house would then either be sold or the wife could buy her husband’s share in the property, which it was agreed should only be 12.75%. This was despite the fact that the husband had been the main financial contributor to the property.

The husband also agreed to pay our client child support over and above his statutory obligation.
