We advised our client on a clinical negligence claim arising from the tragic death of her daughter at Kingston Hospital. Our client’s daughter died due to gross negligence of a doctor who failed to treat developing sepsis. Our work included representation of the family at an Inquest and bringing a successful compensation claim against the hospital Trust.
The claim included a secondary victim claim for the psychological injury suffered by our client, as a result of the events she witnessed around the time of her daughter’s death. This aspect of the claim was strenuously denied by the Defendant Trust. We secured an out of court settlement of £65,000 for our client.
We secured compensation, which represented justice for our client and an acknowledgement of the failings of the Defendant Trust. Whilst the compensation is only money, it provides security for the Claimant’s future and that of her family.
We fought hard to achieve justice for our client, in the secondary victim case, which was strenuously denied. Secondary victim claims have been especially difficult in recent months due to rapidly-developing case law, which has mostly been favourable to the Defendants. However, we felt that this was a very important case to pursue and that our client deserved justice.
We also helped our client by securing an out-of-court settlement before issuing the claim at court. This avoided the need for her to be assessed by an expert instructed by the Defendant, which could have been an additional upsetting experience for her.
We also liaised with the media during and after the Inquest. Our client and her family were keen to raise public awareness and hoped that care at the Trust would improve as a result. Our work involved publishing press releases, speaking to the press, supporting the Claimant’s family in a television interview and also giving a short television interview ourselves.
