Beth specialises in property work across a number of business sectors. This includes: Property Development – Beth is experienced in advising on assembling land to facilitate brownfield regeneration. She has prepared option agreements and conditional contracts to enable the co-ordination of land assembly. Beth has also negotiated agreement for leases and leases in both housing and retail mixed-use developments with anchor tenants. Education – advising on trust school transfers from local authorities to new trust companies following a decision to acquire a foundation under the School Standards and Framework Act 1998. This includes advice on the title, shared use agreements with existing users and occupiers and on references to the Schools Adjudicator where transfers are slow to be completed. Beth also advises both academies and their sponsors on academy projects. This includes advising on the Partnership for Schools’ standard form development agreement, long lease and short term occupational leases and licences. Frequently such projects are run within tight timescales, so the quick turnaround and review of title and property documents is key to enabling the construction of new academy buildings to start as planned. Health and Social Care – advising on the sale, purchase and refinancing of care home stock. In the case of sales, this includes advising on the statutory consents needed for disposals and, where necessary, ensuring that the Charity Commission has approved any disposal scheme. Beth has also advised on the reservation of overage on the sale of land with remaining development potential. Beth’s work also includes assisting with day-to-day management issues like leases and negotiating licences for alterations and access and crane oversailing licences for care home extensions. The Third Sector – Beth advises charities and social enterprise companies on their property portfolios. This can range from advising on Community Asset Transfers from local authorities to community associations by way of long leases to reviewing and advising New Deal companies on their strategic direction and utilisation of their assets once the government programme providing their funding ends.
