Construction and Procurement Law
We advise on all aspects of Construction Law, Maintenance and Procurement, from Adjudication to Z clauses, and from contract strategy to commissioning. Our team is known particularly for partnering contracts and advising on the EU procurement rules.
We can help you:
- set up partnering contracts, framework agreements and development agreements for maintenance, refurbishment and new build development programmes;
- navigate the EU procurement rules where they apply;
- identify risk areas in tenders you are responding to;
- tailor standard consultant appointments and collateral warranties to reduce your risks; and
- resolve construction and contract disputes through negotiation, mediation or adjudication.
As well as partnering contracts, such as the NEC suite and PPC2000/TPC2005 contracts, we also advise on the JCT05 and other standard forms. Our in-house consultant engineer, Ross Hayes, wrote the flow charts for the Term Service Contract and other NEC3 contracts.
Andrew Millross, Partner, wrote the National Housing Federation Guide to the EU procurement rules. Mark Cook, Partner, has a national reputation for securing community benefits (jobs and training) through construction and other contracts.
Andrew Lancaster, Partner, a CEDR accredited mediator, leads our construction dispute resolution team that:
- resolves both small and multi-million pound construction disputes;
- advises local authorities and social housing providers on appropriate dispute resolution, contract termination and reprocurement processes in the light of their governance, public law and other responsibilities; and
- brings and defends claims involving construction professionals.
We act for contractors, professionals, developers, subcontractors and funders so we can see issues from the viewpoints of all stakeholders.
Please speak to our construction, maintenance and procurement law team if you:
- need help with your contract strategy;
- are procuring or tendering for a construction contract;
- want advice on a professional appointment or collateral warranty;
- use the NEC, JCT or PPC2000 or would like to, and need advice or training on it;
- have to follow the EU procurement rules or want training on them; and
- are involved in a construction dispute or may need to terminate a contract.
